Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, Drasken Labs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Drasken Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your violation of these Terms or your use of the Services.

Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree that the courts located in New Delhi, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

Cancellation & Refund Policy

DRASKEN LABS PRIVATE LIMITED believes in helping its customers as far as possible, and has therefore a liberal cancellation policy. Under this policy:

• Cancellations will be considered only if the request is made immediately after placing the order. However, the cancellation request may not be entertained if the orders have been communicated to the vendors/merchants and they have initiated the process of shipping them.
• DRASKEN LABS PRIVATE LIMITED does not accept cancellation requests for perishable items like flowers, eatables etc. However, refund/replacement can be made if the customer establishes that the quality of product delivered is not good.
• In case of receipt of damaged or defective items please report the same to our Customer Service team. The request will, however, be entertained once the merchant has checked and determined the same at their own end. This should be reported within 15 days of receipt of the products. In case you feel that the product received is not as shown on the site or as per your expectations, you must bring it to the notice of our customer service within 15 days of receiving the product.
• In case of complaints regarding products that come with a warranty from manufacturers, please refer the issue to them. In case of any refunds approved by DRASKEN LABS PRIVATE LIMITED, it may take 6-8 days for the refund to be processed to the end customer.
